These Terms of Service (“Terms”) govern your use of the website https://vapify.agency (the “Service”) and any related products or services provided by Kanzu Code Inc. (“Kanzu”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not access or use the Service.
Kanzu provides a white-label interface platform for third-party AI voice services (“Platform Services”), and may also provide custom development services (“Custom Services”). Kanzu does not operate or control the underlying AI voice services (such as Vapi or Retell) or the telephony or call recording functionality provided by those third-party providers. Use of these third-party services is subject to their respective terms of service.
If you purchase Custom Services, you may be required to provide payment and billing information, including credit card or PayPal details. You represent and warrant that:
Kanzu may share necessary payment information with third parties to facilitate processing of your purchase. We reserve the right to refuse or cancel orders for any reason, including suspected fraud or errors in pricing.
Certain Platform Services are billed on a subscription basis (“Subscription”), on a monthly or annual Billing Cycle. Subscriptions automatically renew under the same conditions unless canceled by you or by Kanzu.
You must provide valid billing information, and by submitting payment information, you authorize Kanzu to charge all Subscription fees to that payment method. If automatic billing fails, you will be notified to complete payment manually.
Refunds are considered on a case-by-case basis at Kanzu’s sole discretion. Refunds may only be granted for issues directly caused by Kanzu’s Platform Services. Issues originating with third-party AI providers are not eligible for refunds.
Kanzu acts solely as an interface to third-party AI voice providers. Kanzu does not guarantee the functionality, accuracy, availability, or compliance of third-party services. You acknowledge that:

Kanzu may create an account for you automatically when you register for a free trial or purchase a subscription.
You may request deletion of your data, except where retention is necessary to process purchases or comply with legal obligations.
Kanzu may modify subscription fees at any time, effective at the end of the current Billing Cycle. Reasonable notice will be provided. Your continued use after the fee change constitutes acceptance of the new fees.
Kanzu strives to provide accurate information about products and services but does not guarantee that all information, pricing, or availability is correct or complete. Information may be updated without notice.

You agree to indemnify and hold harmless Kanzu, its officers, directors, employees, and affiliates from any claims, damages, or liabilities arising from:
Kanzu provides support for Platform Services while they are actively maintained. We do not guarantee resolution of all support requests or compatibility with every third-party service. Kanzu reserves the right to discontinue support or products at any time.
Kanzu may suspend or terminate your access for violations of these Terms. You may cancel subscriptions at any time. Upon termination, all licenses granted to you will immediately cease.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
